1. Acceptance of Terms

By accessing or using the MedClinic24 platform operated by SourceForge Software Services Pvt Ltd (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree, you may not use our services. These terms apply to all visitors, registered users, and anyone who accesses the platform.

2. Account Terms

• You must be a licensed medical practitioner registered with an Indian medical council (or authorised representative of a clinic) to create a doctor account.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• You must provide accurate and complete registration information and keep it up to date.
• One person or legal entity may not maintain more than one free trial account at a time.

3. Description of Services

MedClinic24 provides a software-as-a-service platform that includes website building, online appointment booking, AI content generation, telemedicine video consultations, e-prescription management, and patient communication tools. Features available to you depend on your subscription plan.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will notify you of material changes via email or in-app notification at least 30 days in advance.

4. Payment Terms

• All paid plans are billed in Indian Rupees (INR) on a monthly or annual basis, depending on the billing cycle you select.
• Prices are exclusive of applicable taxes (GST) unless stated otherwise.
• Payments are processed through Razorpay. By subscribing, you agree to Razorpay's terms of service.
• If payment fails, we will retry up to three times over seven days. If all attempts fail, your account may be downgraded to a limited free tier until payment is resolved.
• Refunds are available within 30 days of your first paid subscription. After 30 days, you may cancel at any time and retain access until the end of your current billing period.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload, share, or transmit content that is defamatory, obscene, or infringes on intellectual property rights.
• Attempt to gain unauthorised access to other user accounts, our servers, or related systems.
• Use automated tools (bots, scrapers) to access the platform without written permission.
• Misrepresent your medical qualifications or professional credentials.

6. Data Ownership

You retain full ownership of all content, patient data, and materials you upload or create on MedClinic24. We do not claim any intellectual property rights over your content. We may use anonymised, aggregated usage data to improve our services.

Upon account termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our data retention policy.

7. Termination

You may cancel your account at any time from your dashboard settings. We may suspend or terminate your account if you violate these terms, fail to pay fees, or if we are required to do so by law. Upon termination, your right to use the platform ceases immediately, though we will make your data available for export for 30 days.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SourceForge Software Services Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of MedClinic24.

Our total cumulative liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. MedClinic24 is a practice management tool and does not provide medical advice. All clinical decisions remain the sole responsibility of the treating physician.

9. Disclaimer of Warranties

The platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the service.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of MedClinic24 shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify registered users of material changes at least 30 days before they take effect. Your continued use of MedClinic24 after the effective date constitutes acceptance of the revised terms.
